1. Overview
This website is operated by Provisional Golf Clothing ("we," "us," "our"). By visiting our store or buying from us, you agree to these Terms of Service, our Refund Policy, Shipping Policy and Privacy Policy. If you don't agree, please don't use the site.
2. Eligibility
You must be at least the age of majority where you live, or have a parent or guardian's permission, to place an order.
3. Products
Our products are printed or embroidered to order by our fulfillment partner. We do our best to show colors and details accurately, but screens vary, and small differences in color, print placement and sizing can occur. Product descriptions, prices and availability may change without notice.
4. Orders and payment
Placing an order is an offer to buy. We may refuse or cancel any order, for example if a product is listed at an incorrect price, if we suspect fraud, or if we can't fulfill it. If we cancel an order you've paid for, we'll refund you in full. Prices are shown in U.S. dollars unless stated otherwise. Taxes and shipping are calculated at checkout. Payments are processed securely by our payment providers; we don't store your full card details.
5. Shipping, returns and refunds
Shipping is covered by our Shipping Policy. Returns, replacements and refunds are covered by our Refund Policy. Both are part of these Terms.
6. Intellectual property
All content on this site, including the Provisional Golf Clothing name, the "P" logo, product designs, slogans, illustrations, text and images, belongs to Provisional Golf Clothing or its licensors and is protected by law. You may not copy, reproduce or use it for commercial purposes without our written permission.
7. Acceptable use
You agree not to misuse the site, including by attempting to interfere with its operation, gain unauthorized access, place fraudulent orders, or use it for any unlawful purpose.
8. Third-party services
Our store runs on Shopify, and orders are fulfilled by third-party partners. Payment, shipping and other third-party services are subject to those providers' own terms. We aren't responsible for their content or practices.
9. Disclaimer
The site and our products are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties not expressly stated in our policies, including implied warranties of merchantability and fitness for a particular purpose. Nothing in these Terms limits rights you have under consumer protection laws that can't be waived.
10. Limitation of liability
To the fullest extent permitted by law, Provisional Golf Clothing will not be liable for any indirect, incidental, special or consequential damages arising from your use of the site or our products. Our total liability for any claim will not exceed the amount you paid for the product involved.
11. Indemnification
You agree to indemnify and hold Provisional Golf Clothing harmless from claims arising out of your breach of these Terms or misuse of the site.
12. Governing law
These Terms are governed by the laws of the State of Utah, United States, without regard to conflict-of-law rules. If you are a consumer in another country, you may also be protected by mandatory laws where you live.
13. Changes
We may update these Terms from time to time. Changes take effect when posted on this page.
